Marketplace & Seller Terms

1. Marketplace Overview

Kimbela provides a marketplace that enables independent sellers to list and offer products or services. Kimbela is a technology platform and is not a party to transactions between users.

2. Seller Eligibility

• Be at least 31 years of age
• Provide accurate and truthful information
• Have the legal right to offer products or services
• Comply with applicable laws and regulations

3. Seller Responsibilities

• Provide accurate, complete descriptions
• Deliver products or services as described
• Maintain professional communication with buyers
• Ensure products are safe, lawful, and fit for purpose

4. Listings and Content

Listings must be truthful, clearly priced, and free of prohibited content. Kimbela may edit or remove listings that violate policies.

5. Subscription Model

Marketplace access may require a subscription. Payment does not guarantee sales, visibility, or engagement. Subscription fees are generally non-refundable unless required by law.

6. Advertising and Promotions

Paid promotions increase exposure but do not guarantee results. Kimbela does not endorse promoted content.

7. Transactions Between Users

All transactions are between buyers and sellers. Kimbela does not control pricing, delivery, or dispute outcomes.

8. Payments and Financial Responsibility

Sellers manage payment arrangements with buyers. Kimbela is not responsible for payment failures or disputes between users.

9. Refunds and Returns

Sellers define their own refund, return, or cancellation policies. Buyers must resolve disputes with sellers directly.

10. Prohibited Listings

• Illegal goods or services
• Fraudulent or deceptive products
• Sexually explicit or discriminatory content
• Harmful, unsafe, or misleading offerings

11. Platform Moderation

Kimbela may remove listings, restrict access, suspend, or terminate seller accounts to protect users and the platform.

12. Intellectual Property

Sellers retain ownership of their content but grant Kimbela a license to use it for platform operations and marketing.

13. Limitation of Liability

Kimbela is not liable for products or services offered by sellers or for disputes between buyers and sellers.

14. Indemnification

Sellers agree to indemnify Kimbela and affiliates from claims arising from their listings or interactions.

15. Updates

These Marketplace Terms may be updated over time. Continued use constitutes acceptance.

16. Governing Law

These Marketplace Terms are governed by the laws of the Federal Republic of Nigeria.
